  • THE Right to Information activist and winner of Ramon Magsaysay award sits in his spartan office, juggling multiple phone calls, drafting letters and typing out an urgent press release alongside. Surprisingly there’s a rhythm in the mayhem. The former IITian talks to Urmila Rao and explains why he no longer takes up cases of aggrieved college students, the limitations of RTI and much more

    Q: From an IRS officer to an activist, why and how did the change happen?
    A: When I was in the job, I started doing these things part-time and felt that the value I am bringing here was far better. On the contrary, what I was doing in the Income Tax department could be done by anyone else.

    Q: When did the RTI journey begin?
    A: RTI came much later. Initially I, along with some others started addressing corruption issues, wherein a common man had to pay a bribe to get his work done. The concern was how to create a bribe-free atmosphere. So we started advising customers who came to the Delhi Vidyut Board and Income Tax Department, not to pay bribes in these two departments. We told them that if they have a problem they can come to us and we will get their work done free of cost. So we used to gather grievances of people and collectively present those complaints to the chair of the department and add to public pressure.

    Q: Were you an activist during school days as well?
    A:
    I was completely a kitabi keera (book worm). I did not do anything but study.
     
    Q: You have worked for government schools. Why not for colleges?
    A: It is a different matter to take up the cause of poor people who can’t fight for themselves. They are from under privilaged backgrounds. Working for such students is understandable. However, in case of engineering college students or others, where the middle class goes, I am sure they can fend for themselves. Let people who are suffering from existing malpractices take up the cause. Every person in this country is suffering because of bad governance. A few NGOs will not be able to take up this job. So people who are suffering will have to take up the cudgels.

    Can you give students step-by-step guide for filing RTI application?
    • RTI is about seeking information from any government department, so you just need to write an application on a piece of paper whatever information that you want from the government.
    • There is a Rs 10 fee, which one needs to deposit in the department.
    • The Dept. is supposed to give information in 30 days.
    • If you don’t get information in that time period, you can file an appeal. There is a penalty clause for officers if they don’t provide information in 30 days.

    Can students come to you, if they need guidance?
    We have a helpline number: 9718100180. We can help in drafting the letters. We don’t take up any student’s case, we just guide them.

    Q: How wise is it for students to compromise on career and get entangled in a time-consuming legal process?
    A: Right. So, let him find some people who can do something for him. People first of all have to find courage. It is precisely students of this very country, who at the time of Quit India Movement gave up their studies, left colleges and that is why our country got independence. If someone thinks that education, health, infrastructure all are different sectors and issues there ought to be fought independently, then they are mistaken. There is an underlying pattern in the process. And that is bad governance. So unless you tackle governance, unless you tackle corruption you will not be able to solve any of these problems.

    Q: So a collective fight is warranted against bad governance from students?
    A:
    Leadership has to come from these students. In Chattisgarh there was huge corruption in the State Civil Services exam. There were some students who took the exams but couldn’t get through. They filed an RTI. Others did not. They thought that if they file RTI applications, in the next attempt they will be victimised.

    It is very natural that if you are appearing for Civil Services examination and if you can make their life miserable they can also do the same to you. But one group of students filed RTI, and got all the answer sheets. The Civil Services Exam turned out to be a huge scam. Some students were given 306 marks out of 300! The students then moved the High Court which cancelled the exam. So someone took up the battle. They did not off-load the battle on someone else.

    Q: Despite all the fighting spirit, getting justice is still a complex process, something of a dampener…
    A: So who will do it? In our organisation, there is a 23-year-old girl whose throat was slit by the ration shopkeepers. She was fighting battle for the poor people so that there in no corruption in ration system. She was 19 at the time. Post the incident, she had a lot of pressure from her family to withdraw from her work. She said, if I don’t do it, who will? No one will come from America, or Japan. We have to do it.

    Q: An inherent drawback of RTI is that the applicant’s identity is open, putting his life at risk.
    A: The only way to minimise risk is to adopt strategies. A group of people can file an RTI rather than one person. There could be people from several cities filing the same application, for example, 10 people from Delhi, 10 from Kolkata, from Mumbai and so on.

    Q: Do you fear for your life?
    A: Yes. Every one does. We got threats many times. Attacks from a mafia gang from Uttar Pradesh has taken place several times. Many threats came when we were dealing with the ration issue, which has been the toughest fight.

    Q: How long have you been filing RTIs for schools? And what has been  the outcome?
    A:
    We just did it for a year or so. We wanted to understand the whole issue. Outcome was nothing. We just got statistical information; how much budget is coming, how many students are there. Filing RTI will not be able to improve the government education system.

    Q: So what’s the alternative?
    A:
    For long, we filed issue-based RTIs. Now we begin to realise that this system cannot function, we need to have a law.  So we now focus on overhauling of the system. We have drafted some laws, which basically say that in urban areas ‘Mohallah Shabha’ and in rural areas ‘Gram Shabhas’ should be constituted. They should have the power to decide how the government fund is spent in that area, what facilities should be there. People should make the decisions. Let the people decide the appointment of a teacher. Government should just implement those decisions. We are calling our campaign ‘Swaraj campaign.’

  • We, the nation in Corruption Ferno...! When there be fire in our home it's essential to act fast. To contain fire if there be need to bresk the lock or even the precious door however costly it may be have to be broken... & no hesitations or nonsense discussions are made or expected from the person owning that house.. It's common knowledge, the Law do not generally permit to break the door but we are concerned more and take resort to the utmost extreme importance to the life & property .. all this needs no any emphasis... Now, consider the current case, fight against corruption in India. It's worst than wild fire already burnt the nation & minds of majority (over 99%) of citizens. The fire has engulfed over all the domains&systems.. and unfortunately the fire fighters (persons sitting or occupying highest seats of power and executive governance) are seen working in complete controversial roles.. It's unfortunate, to find the persons sitting at top expected to fighting against are talking of Laws and seen their attempt to put explosive rd x bombs one after the other in addition to fuel. Why would some (Sibble- seen talking senseless with back biting &Amar- radially obtaining data on4different CDs ) act with extra efficiency and still there be no requisite reactionary responses such as from respected Supremo/s? If need be now is the signal to act and break all the walls, doors if just not the lock/s.. "Discussions or arguments on Laws" have never been seen in war, fire emergency situations.. especially that do not suite to the persons sitting in chairs of high power & executive governance ... Treat them like criminal conspirators if do not follow real interest of our home, our nation...!

The firm was established in the year 1981.with a view to manufacture garments and to export to foreign countries. The firm started manufacturing and exporting garments of various descriptions to Sweden, Norway, West Germany, France, Italy, Belgium, Netherlands and Hungry. Firm earned un-matching goodwill in the foreign markets due to their excellent quality and adhering to time frame and maintaining punctuality. Because of this goodwill firm started getting huge orders from its foreign buyers .To meet the commitment the firm was outscoring there products from reputed garment manufacturers in India. The firm is registered with Small Scale Industries under Registration No. 555582360 and was duly renewed every year. Turnover and profit of the firm increased tremendously year by year till 1993 as is reflected below. Owing to financial losses, their profit started to decline and the firm started incurring huge losses from the year 1993 onwards. The proprietor was forced to close the firm in order to avoid incurring further losses. Details of year wise turnover and profits earned by the firm are given below. Szentex International Ltd., H-1112, Budapest, Brasso u-89. The said consignment was insured by M/s. United India Insurance Co. Ltd. Moolchand Branch, New Delhi having their Head Office at 24, Whites Road, Madras – 600014 under Marine Open Policy No. 41200/21/06/11/75/92 for an aggregated amount of USD 4,99,000 i.e. CIF value plus 10%. = USD 5,48,900.00 The firm M/s. Shilpi Modes while executing one valued order of M/s. Szentex International Ltd., H-1112, Budapest, Brasso u- 89, had shipped a consignment of 499 Cartoon containing 49,900 pieces of Embroidered knitted garments having CIF value of USD 4,99,000.00 vide invoice Nos. dated …………….. respectively to be delivered to their customer at Budapest Hungry. The said consignment was insured for all risk (transit Insurance) by M/s. United India Insurance Company Ltd., Moolchand Branch, New Delhi under Open Marine Policy No. 41200/21/06/11/75/92 (Cover Note Nos. 014911 to 014915) for an aggregate amount of USD 5,48,900.00 only. Subject insurance was from warehouse of the consigner (seller )to the warehouse of the consignee( purchaser ) Part of this consignment consisting of 300 Cartons was dispatched from Delhi to Mumbai by trucks vide L.R. No. 929990 and balance 199 cartoons was dispatched vide LR No. 92991 for balance 199 cartons both dated 28th December 1992. The said consignment reached safely to Bombay (Now Mumbai) and after completing custom clearance formalities the said consignment was handed over to M/S Merzario Marittima multi model transporter under combined bill of lading No. PET /261/HAM, dated…… to be transported to its final destination i.e Budapest Hungry and to be delivered to buyer (consignee) M/S Szentex International Ltd. Entire freight and other charges were paid in advance including loading/unloading charges at various places to the transporter/carrier which is clearly mentioned on the said Bill of lading. The multi model transporter reportedly booked the said consignment by see per vessel “PTR.DUTO” from Mumbai and was to discharge the entire cargo at sea port Humberg, west Germany in container NoMERU446-143.The said cargo was then to be sent by rail/road to Budapest by M/S Merzario Marittima (Multi Modal transporter) The entire consignment either was lost, damaged, or pilfered during transit presumably after the vessel was unloaded in Humburg, the consignment might have got moldy or completely damaged .However what ever the case may be the consignment never reached to the buyer. On receiving the information about the consignment having been lost or damaged during Transit the firm M/s Shilpi Modes after making proper enquiries and on receipt of the letter dated 9.11.1993 from their buyers, immediately informed the designated surveyors “HUNGARIAN CHAMBER OFCOMMERCE( Hungarian name of the ….should be mentioned here …….as mentioned in the insurance policy )-Corporation of Average Adjusters And Agents of the Insurer M/s United Insurance Company Limited . The surveyors after making proper Investigations as per their norms issued five separate survey reports in respect of five involved invoices bearing No. 393/527/A, 393/527/B, 393/527/C, 393/527/D, 393/527/ E , all dated 26.07.1993 mentioning that the goods have either been lost, or pilfered or damaged in transit and certifying the total monitory loss USD 548,900.00 on account of entire consignment. M/S Shilpi Modes as Per norms of marine survey paid survey fee of the surveyors M/S Shilpi Modes there after submitted these survey reports along with monetary claim, amounting of USD 550,000.00 duly completed claim form, claim bill copies of all the 5 export invoices ,duly filled in and signed subrogation letters, under certificate nos. Dr/92/014911, Dr/92/014912, Dr/92/014913, Dr/92/014914, Dr/92/014915 and all other required documents to their insurers (United India Insurance Co., Ltd )for settlement of their claim. M/S United India Insurance Co., Ltd vide their letter No. ESN: VL: 94dated 22.02.1994 repudiated the said claim and in the same letter advised them to file a suit against the carriers to protect the rights of recovery. M/S Shilpi Modes acting on the advice of their insurers filed Admiralty suit in Bombay High court , claiming an amount of USD15,31,300.00 as detailed later in the report against the following carriers:- (1) M/S M.V. PETER. DUTOV a foreign Flag vessel. (2) Marzario Maritime – SRL a foreign Company having its registered office at torre Shipping, via De Marini 53 16149, Genova, Italy. (3) Owners, /Managers/all those interested in the first defendant Vessel. DETAILS OF C LAIM DECLARED IN THE SUIT 1. Invoice value in respect of 5 invoices USD. 499,000.00 2. Interest @ 24% Per annum from 5th feb.1993 To 28th Feb 1994 USD. 127,300.00 3. Claim from from consignee/buyer USD 180,000.00 4. Consequential losses on account of non-receipt Of the proceeds under the invoices and due to Non-execution of export orders USD 700.000.00 5. Various expenses incurred in respect of Foreign trips/legal expenses USD 25,000.00 -------- TOTAL USD 1,531,000.00 --------- Subnect suit in the High court of Judicature at Bombay Admiralty and vice Admiralty jurisdiction, admiralty suit NO 23 0f 1994 was disposed off by the subject court on 12th July 2002 by allowing the suit in terms of the prayer as under:- a) Invoice value in respect of 5 invoices USD. 499,000.00 b) Claim from consignee/buyer USD 180,000.00 c) Various expenses incurred in respect of Foreign trips/legal expenses USD 25,000.00 d) Interest @ 8% on the principal amount of U.S. Dollars7,04,000.00 till date and further USD 5,30,484.00 TOTAL USD 12, 34,484.00 PLUS ,Interest @ 8% p.a. on the principal amount of U.S.D 7, 04,000.00 from the date hereof till the date of payment. By the time the nudgment was pronounced one of the defendants M/S Marzario Martime - SLR had been wound up and liquidation formalities had also been completed. M/S Shilpi Modes had therefore no alternative but to take legal action against their insurers. M/S United India Insurance Co, Limited and it has filed a Complaint ( OP no 114 of 2003 ) in the National Consumer Disputes Redressal commission, New Delhi . . Because of non delivery of the subject consignment, their buyer did not continue to do further business with the said firm. The firm also could not continue the said business because of paucity of funds. The firm could not keep the commitment with other buyers. After struggling for some time, the firm ultimately was forced to close its business and incurred so many other expenses. All their business assets amounting to about Rs. 19, 33,797.00 completely turned into junk and had to be dispose off as a scrap. The firm could not keep its commitment with other buyers/customers.and pending export order of this buyer for USD ….had to be discontinued . Had the insurers not repudiated this claim the firm would have continued its business and made a good headway and their turnover as on to day would have crossed Rs. 300 Cr and would have also earned an aggregate net profit of Rs.275 Cr. The detailed working showing that their turn over would have been to the tune of Rs.289,68,47,390 as on 31st March 2010 is detailed in annexure B. and that their aggregate net profit would have been to the tune of Rs.2,61,43,42,609 as detailed in annexure B1. Goodwill of the firm when measured in monitory terms is to the tune of Rs 68 lacks as on 31st march 1993 as per details in Annexure C. If this goodwill of the firm as a going concern is calculated in the monitory terms as on today, the same would cross Rs.50 Cr. Based on the audited documents of the firm, confirm orders of their buyers, invoices pertaining to the lost consignment, court orders, repudiation letter of their insurers, insurance policy and other information produced before us ,we are of the opinion that the firm M/S Shilpi Modes, if, would have continued its business of export of garments out side India would have earned a net profit of Rs. 2,62,43,42,609.00 (Rupees Two hundred sixty two carores forty three lakh forty two thousand and six hundred nine only) from 1st April 1993 to 31st March 2010. We are therefore of the opinion that the firm M/S Shilpi Modes has suffered a net loss of 2,62,43,42,609.00 (Rupees Two hundred sixty two carores forty three lakh forty two thousand and six hundred nine only) from 1st April 1993 to 31st March 2010, besides loss of fixed assets amounting to Rs.19,33,797 less scrap value (Rupees nineteen lakh thirty three thousand seven hundred ninety seven only). We also confirm that in case the firm M/S Shilpi Modes would dispose off their firm as a going concern along with goodwill, they would have been in a position to negotiate the value of the goodwill of the firm at Rs 50 crores.
