In India, individuals with a disability of 40% or more are eligible for reservation benefits under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.


However, the Rights of Persons with Disabilities Act, 2016, has expanded the definition of disability and increased the reservation quota. As per the new Act:


- 4% of seats are reserved for persons with benchmark disabilities (which includes disabilities with a severity of 40% or more) in government-funded institutions.

- 5% of seats are reserved for persons with disabilities in all government-aided institutions.


While 25% disability does not qualify for the reservation benefits under the central government, some state governments may have their own policies and schemes for persons with disabilities.
