Only they choose public prosecutor as a legal advisor??

mahimadogra_6929406 Student Expert 18th Jul, 2018

Hey Ganesh

Public Prosecutors and Legal advisors are different. Public prosectors are the lawyers who conduct the case on the behalf of the government. They represent the state in cases of a criminal trial.

Whereas Legal advisors are not the same as public prosecutors. They can be appointed by private companies, MNCs, firms, organisations, government organisations or departments for the purpose of advising or representing  on various legal matters.

You do not need to be a public prosecutor in order to be selected/ employed as a legal advisor. Different organisations have different criteria for selection which maybe specialisation in an area of law or some minimum years of practice etc depending on the job profile.

To become a civil lawyer is it necessary to do LLM

mahimadogra_6929406 Student Expert 13th Jul, 2018

Hey Prity.

No, it is not necessary to do LLM in case you want to become a civil lawyer. You can start practicing as a lawyer in the civil field after completion of your LLB degree. LLM is just an additional masters degree if you want to specialise in some specific area, but it is not compulsory/ mandatory.

Best of luck!

I AM CONFUSED BETWEEN COMMERCIAL LAW?, CIVIL LAW?, AND BUSINESS LAW? AND WHEN DO WE STUDY THOSE IN LLB OR LLM?

Gaurav Jain 19th Jan, 2018

Hi Mayank, thanks a lot for your very interesting question.

Law can be broadly classified into Criminal law and Civil Law. Criminal law deals with behavior that is or can be considered as an offense against the public or the society—even if the immediate victim is an individual. Examples are murder, assault, theft, and drunken driving.

Civil law deals with behavior that constitutes an injury to an individual or other private party, such as a corporation. Examples are defamation, breach of contract, negligence and property damage. (for a detailed comparison, check out this link - https://www.britannica.com/story/what-is-the-difference-between-criminal-law-and-civil-law )

Having understood the above difference, here's a quick question – under which of the above two categories would you place Business law and commercial law? If you said, Civil Law, you are correct!

Commercial law focuses on the sale and distribution of goods, as well as financing of certain transactions. Business law focuses on the other aspects of business, including forming a company, mergers and acquisitions, shareholder rights, and property issues such as leasing office or warehouse space. A business that sells products will almost certainly need a lawyer with experience in both of these fields. These two fields of law have so many overlaps that some people now-a-days use the two terms synonymously.

If i m doing bba llb so there is option of professor

Anonymous 8th Jun, 2017
After you do 5 year law studies you can give AIBE entrance exam based on which you can practice law and even start teaching on a basic level and after some good amount of experience.
Then you can opt for LLM and then teach as a professor in universities but not after 5 year of law.

All the best.
