Even if you fail Inter 1st year you have the feasibility of clearing your subjects along with your 2nd year. In that case, if you can manage to clear all the subjects atleast by the time of counselling, you are eligible for JEE Mains. What matters is you should be completing your 12th at the time of counselling and admission no matter how many subjects you have to clear.
