If report to ARC to confirm my seat for College 3 during CAP round 1, can I get College 5 in the second merit list?

If you think that 5 in your list is better than 3, why do you keep the list like that. Fill according to what you prefer, put on float in CAP 1, and see if you get your higher preferences in subsequent rounds.
