See till now the 75% criteria has not been restored for admissions through JEE-Main and JEE-Advance but if it gets restored next year then you will not be eligible for admission to institutions participating in JOSAA counselling on the basis of JEE-Main and JEE-Advance scores. So if you re-appear for class 12th from open/private board and able to secure more than or equal to 75% aggregate then you will become eligible upon restoring of the criteria. And it is upon you whichever marksheet you use for admission so definitely you should use the one which has better percentage.

Also note that maximum attempts allowed for JEE-Advance is 2 in 2 consecutive years, first attempt in the passing year of class 12th or equivalent examination and second attempt in very next year to that. Similarly for JEE-Main maximum attempts allowed for JEE-Main is 3 in 3 consecutive years, first attempt in the passing year of class 12th or equivalent examination and second attempt in very next year to that followed by third attempt in third year.
