My daughter is studying in Bangalore from kindergarten till 8th grade in ICSE. I am getting job transfer opportunity to Dubai. I am confused as to whether to take my family with me or leave them in India. Many say that my daughter will not be eligible for general quota of CLAT or NEET.

Hi!

I'll begin answering your question by first including some basic information regarding citizenship and eligibility of a candidate to appear in exams like CLAT OR NEET.

Firstly, if you obtain a citizenship of UAE while working in Dubai then you and your family would be considered as Foreign Nationals (India has no provision for multiple citizenships so you and you family will not be official citizens of India).

If you simply work outside of India on a work Visa then you'd be considered as NRI's or Non resident Indians.

This information is relevant if you are planning to get your daughter admitted in an Indian university after her schooling is done. (assuming that she would complete her school abroad)

1) CLAT - All the major NLU's in India reserve seats for 2 extra category of students

(a) Foreign Nationals - who DO NOT have to appear for CLAT and can directly apply for admission through an NLU's website and their high school performance will be considered for admission. (for ex. NALSAR, 2nd ranked NLU, has 24 reserved seats for foreign national students), please keep in mind that the tuition fee for such students is also considerably high (it is a way for NLU's to generate more income)

(b) NRI Sponsored: This is not for NRI students but for those students studying in India who have 1st or 2nd degree family members living abroad as NRI's (only as NRI's not full citizens of the country in question). Such students DO HAVE TO appear for CLAT, naturally since they live and study in India but they get an additional NRI Sponsored category rank apart from their national rank. NRI sponsored students also have to pay higher fees and all major NLU's have some seats reserved for such candidates

2) NEET - Until 2017, candidates who were foreign nations or NRI's or OCI's (overseas citizen of India) were EXEMPT from appearing for NEET exam to apply for admission in MBBS OR BDS courses in India (they could apply directly based on their school marks). After a Supreme Court Directive however, all such students studying and residing outside of India HAVE TO appear for the NEET exam and clear it with a national rank to be eligible for admission.

This change gives rise to a few problems:

- NRI or Foreign National students find it hard to compete with Indian students because of difference in syllabus, lack of proper coaching classes, difference in exposure during schooling etc.

The admission process itself becomes hectic as the student has to apply and get admission with different set of documents, results and ID proofs because schools abroad have different marking schemes and things like that.

If your daughter rejoins an Indian school (at least for the board years of 11th and 12th) then I do not think why it would be an issue for her to appear in national entrance exams as a general category student. She can very well study abroad for a couple years if you plan on returning to India before her High School.

Still reading? Well,  thank you for your patience so far. Now, talking about pros and cons from a personal point of view:

1) It is extremely hard for a student to go through so many shifts in study patterns. In your case your daughter has to change her study pattern from ICSC board to that of a school in Dubai (actually there are many Indian pattern schools in Dubai which can solve this problem) to that of a National level entrance exams which, arguably, CBSE students find much closer to their comfort zone.

2) If your plan is to ultimately get your daughter to study in an Indian university then it is humbly advisable to let her continue her education in India itself for the sake of uniformity and exposure.

3) Otherwise, if your daughter does get to experience school and studies outside of India then you can probably plan for her to carry on her education overseas throughout. She can very easily avoid the hassle and overactive competition of Indian entrance tests and prepare herself for under graduation outside the country (for ex. she could appear for SAT's to get admitted to universities in the USA after her schooling)


All in all, it all depends on your planning for the future and for your daughter's career for which I wish you and her the best of luck.

Thank you very much. If my daughter gets to complete her education till 12th grade in Dubai, are there NRI quota which she will be eligible? Since she has studied in Bangalore for 10 years and I have an apartment, won't my daughter be a domicile? If not, then can she write CLAT in general category? Do we have NRI category where she is eligible? My daughter is interested in Law. That's the reason I was thinking about CLAT. What are the other renowned institutions abroad for LAW. Thanks. I will cover your queries in points:



1) Yes, there is an NRI quota in CLAT that your daughter can avail if she completes her education from Dubai. (NRI is anyone who resides in India for less than 182 days during the course of the preceding financial year) While filling the CLAT form there is an option of NRI/non-NRI category selection.



During counseling, she will be asked for documents like qualifying examination marks sheet, Nationality proof, a true copy of her passport, a certificate from Indian Embassy and her T.C. and other documents.

If she has passed her qualifying examination from a country other than India, she will need to submit a certificate from the Indian Embassy or Indian Consulate or Association of Indian Universities (Delhi) stating that the examination she has passed is similar to the qualifying examination of the Indian system.







2) I have mentioned the basic definition of NRI above, even if your daughter studies in Dubai full time she'd still be an Indian citizen (domicile of any state) unless you take UAE citizenship. She will have to write CLAT under general category plus NRI category (both selected during filling of form)







3) If we are talking about premier world class Law schools then we have Harvard, Oxford, Cambridge, Yale, etc. (IVY League schools in USA and old English universities in the UK) for admission into ivy league USA law schools a candidate needs to have an undergraduate degree of 4 years (they don't have 5 year law programs like India) then clear LSAT (USA) [[Not to be confused with LSAT-India]] which is considered to be one of the most challenging exams in the US because it is highly logic and reasoning based. For law schools in UK, they have 3 year LL.B programs that also need an undergraduate degree to apply into - they don't have a national exam for law so candidates have to apply to their college of choice individually.







Note- the 5 year law program that we have in India is very unique, as in, it allows admission right after 12th. Other than that CLAT is far easier than LSAT (USA) because LSAT (USA) is a graduate level exam.



Another true fact is that if your daughter gets into one of the top NLU's in India then it becomes very easy from there to go do LL.M or J.D from abroad because good universities abroad ask for a student's versatility and experiences which is abundant in top NLUs. Many students from NLUs and other top law schools in India go for LLM from Oxford and Harvard every year. The 5 years of good academic environment and freedom that they get here is plenty to build a student's CV as per Harvard or Yale standards.
