12 MonthsIn recent decades, Alternative Dispute Resolution (ADR) has become increasingly important in the legal system. Municipal laws across different jurisdictions have given courts the power to direct parties towards using ADR mechanisms if they have previously agreed to do so. This means that adjudication by courts has become an alternative to dispute resolution systems agreed upon by parties. Bilateral agreements and private contracts now often include dispute resolution clauses that cover pre- and post-dispute settlements through methods such as arbitration, mediation, negotiation, or conciliation.
The significance of ADR mechanisms has grown, and there is now a demand for specialists in these areas. For example, the Singapore Convention and the recent codification of pre-litigation mediation for commercial matters have increased the need for experts in alternate dispute resolution. As a result, ADR mechanisms have become vital in both commercial and non-commercial matters.
