An ADA, or Assistant District Attorney, is another common term for an Additional Public Prosecutor in India appointed by one's respective State Public Service Commission or Government at the district level. As per Section 2 (15) of the Code of Civil Procedure (CPC), an attorney comes under the definition of a 'pleader', that is any person who has the right to appear or plead for another in court. Thus, in essence, an ADA is a pleader on behalf of the Government. It is important for any aspiring ADA to keep in mind that they are not going to be representative of the state, and not any particular party. Apart from representing the state in various criminal/civil cases in courts, another major responsibility is to tender legal advice on various departmental matters while posted in various state departments. The eligibility criteria for being appointed as an ADA varies from state to state. For example, in Haryana, a person applying to be an ADA should not be below 21 years and not above 42 years of age, but in Punjab, one cannot be more than 30 years of age. Also, Punjab requires one to have obtained two years of experience with the State Bar as an advocate but Haryana has no such requirements. What is compulsorily required however is a Bachelor of Law degree, membership of the State's Bar Council which enables one to practise, and the clearing of the State Public Commission's qualifying process, comprising a written exam and Viva Voce/Interview. Candidates should be well-acquainted with the topics of both Civil and Criminal Law including the Code of Civil Procedure, Indian Evidence Act, Indian Contract Act, Indian Partnership Act, Customary Law, Indian Penal Code, Criminal Procedure Code and Indian Evidence Act. There will also be questions from General Awareness and English Language. The Viva Voce, or interview, will be a test of the candidate's professional knowledge, speaking ability, ethics and values, alertness, decision-making and other such qualities. An ADA is remunerated as per Government standards, through the standard starting basic pay band of Rs. 9300-34800 along with Rs. 4600 in Grade Pay and Rs. 200 in Special Pay. In the future, one will have the prospects of promotion to Deputy District Attorney/District Attorney or equivalent posts on a seniority-cum-merit basis. To be able to serve the Government in the role of an Attorney is a matter of pride. A successful ADA is known for their persuasion skills, writing and listening abilities, critical thinking and problem-solving skills and social perceptiveness.
