The passing mark depends upon the cutoff in AIBE, which varies every year and is decided by the BCI. Previous year, the cutoff for general category was 38. So, as per the last year cutoff, with 40 marks, you would have qualified the exam.

Still official key is not yet released. According to the resources we have key will be released in the fourth week of december.
So we can expect the key may release within 1-2 days.

yess there is a failure rate in AIBE EXAMS which differs from states to states for example in one of the past year only 63% of the appearing candidates passed the exam this shows that there is a failure rate too in this exam so better prepare yourself
