Hello Sukhvir,According to the the AIIMS MBBS prospectus, the list of documents required at the time of admission to MBBS course at the AIIMS are-Certificate of having passed the 10+2 or equivalent examination. Certificate from the board from which he/she has passed the high school showing the DOB.

In an Indian competitive exam like JEE/NEET, the state from which the candidate has passed class 12th(Board Exam) is considered as his/her home state. In NITs and Government Medical Colleges certain percentage of seats are reserved in home state quota unlike IITs or IISERs.
As you have mentioned that your daughter holds an American passport and an OCI card, therefore, she will be considered under the NRI category. In the said state, OCI candidates are eligible to take admission under NRI category only. However, she can apply for admission to government/private medical/dental colleges. There
No tgere is no discrimination as such, admission is on merit basis and based on Internships, Candidates academic scores and AIIMS exam. There is no official report stating any such preferences towards year gap student so you shoukd just focus on exam preparation
