Explain conventional custom that must be satisfied before the court treats the conventional as incorporated in a contract.
Hello !
There are some conditions which must be satisfied before the court treats the conventional as incorporated in a contract- 1. It must be shown that the convention is clearly established and is fully known,
2.Conventions cannot alter the general law of the land t herefore they are valid only with in the area of their observance,
3. They must be reasonable
The main function of these conventions is to throw light only on such rights and liabilities of the parties on which the contract is silent.
Thankyou!
Hope it helps!
