I think America
Mainly two types of judicial system works.
- Judge based
- Jury based
Both systems have flaws and certain good things.
There is myth about certain country system is great. But, population of the country would be not comparable with others. A jury system in a small country and in America will not be comparable.
Most systems work alike. Precedents (previous rulings of higher court) binding lower courts.
Criminal law has plea bargaining. This system, it is believed had made more innocents in jail in America . On corollary, guilty outside. Keeping innocent in prison is against Justice. The system pushes innocent to be victimised. They may convicted in law and proven. But system failed to deliver justice. However, civil rights in America and Constitutional rights are generally upheld better.
Many Countries had been British colonies and their systems are alike. The people and facilities make difference.
India, has lot of drawbacks. Conviction rate is abysmally low. LEO may not ve effective and corrupt. I found certain unacceptable rulings. Everyone has Constitutional Rights. They must be above laws. But, SC ruled that illegal search can't be ignored and evidence obtained can be used. This may not happen in America.
Poor can get good representation in India. May not in other countries. Well, in bail it may be that Rich get easily than not rich
