The image of the Crossed Bank Cheque/Photocopy of Passbook/Screenshot of Online account is used for identification purposes of the applicant. Hence, they should belong to the applicant which happens to be you. So you have to send image of your Own Passbook  of Bank Account.

In general the debited amount should get refund to your account. You can lodge  a complaint in the respective bank. You can even call to the customer service of respective bank .After this your money would refund with in 7 working days.

It is not necessary for the student to own bank account for JOSAA counselling. The bank account of the parents will also do. The bank account details are required in case of refunds. So, there is no as such hard and fast rule to own an account for the student.
